Under the interim guidance provided by the IRS, if an employer is required by a CBA to make contributions to a multiemployer plan that provides both Minimum Essential and Minimum Value Coverage to an ACA full-time employee, they will not be subject to an assessable payment under section 4980H(a) for that employee.
